1. Organiser

The organiser of this competition is Nubert electronic GmbH, Nubertstraße 1, 73529 Schwäbisch Gmünd, info@nubert.de (‘Nubert’).

2. Eligibility to participate

Persons who are at least 18 years old at the time of participation are eligible to participate. Employees of Nubert electronic GmbH, their relatives and other persons involved in the conception and realisation of this competition are excluded from participation.

Each participant may only take part in one of the quiz questions. Any irregular or repeated participation by a participant in a quiz question will result in their exclusion from the competition. Participation is free of charge and independent of the purchase of goods or services. By participating in the competition, the user accepts these conditions of participation.

3. Participation, duration and prize determination

The competition is open to eligible participants who take part in the various quiz questions on the Nubert 2024 European Championship in the period from 14 June 2024 up to and including 14 July 2024. The quiz questions will be created via the SurveyMonkey service.

For each quiz question, a participant's e-mail address will be requested for participation. This will only be used for evaluation and possible notification of winnings.

The three winners will be drawn at random from all participants.

4. Prize and prize notification

The prize consists of:

1st place: 1 x nuPro XS-8500 RC worth €1,995
2nd place: 1 x nuPro XS-3000 RC advantage set worth €1,390
3rd place: 1 x nuPro AS-3500 worth €895
4th to 14th place: 1x shopping voucher worth €100

Cash payment of the value of the prize in full or in part or exchange of the prize is not possible. The prize is non-transferable.

The winners of the prizes will be notified by e-mail to the e-mail address provided in the survey by 2 August 2024 at the latest.

Once the prize has been accepted and a delivery address has been provided, the prize will be sent to the winner. The postal address will only be used to send the prize. Nubert will bear the shipping costs for deliveries within Germany or Austria. Shipping costs may be incurred for deliveries to other countries.
If a winner does not accept the prize within 2 weeks of the prize notification being sent, stating a delivery address, the claim to the prize will be forfeited. The non-cash prize will also be forfeited if the prize cannot be handed over within 6 months of the first notification of the prize for reasons for which the participant is responsible.

The risk of loss is transferred to the respective winner when the prize is posted. Nubert is not responsible for delivery damage. The winner accepts necessary changes to the prize caused by other factors beyond the control of the companies involved in the competition.

5. Premature termination, exclusion from the competition

Nubert has the right to terminate or suspend the competition at any time in the event of malfunctions, faults, forgeries, manipulations, viruses or damage that affect the administration, security, fairness, integrity or running of the competition. The same applies if legal reasons prevent the competition from being carried out properly. No claims can be derived from premature termination.

In the event of suspected manipulation, Nubert reserves the right to exclude participants from the competition at any time without giving reasons. If the winner has already been determined, the prize may also be subsequently cancelled. A prize that has already been delivered can be reclaimed.

6. Data protection

Nubert stores and uses your data collected for the competition for the realisation and processing of the competition, i.e. in particular for the determination and notification of the winner and the transmission of the prize. The legal basis is Art. 6 para. 1 lit. b GDPR.

The participants' personal data will be deleted from our active systems after the competition has been completed. They will only be archived by us for legal defence purposes, at the longest until any conceivable claims become time-barred (usually three years). The legal basis is Art. 17 para. 3 lit. e GDPR. Winner data is archived for the duration of statutory retention obligations for commercial and tax reasons and to prevent disadvantages for the winner (e.g. product recall). The legal basis for this is Art. 6 para. 1 lit. c GDPR. No further use of your personal data, in particular for our own or third-party advertising purposes, will take place!

We analyse the data received via the quiz questions (with the exception of the e-mail address) to determine the winner and use it to notify the winner.

To conduct the survey, we use the services of SurveyMonkey Europe UC, 2nd Floor, 2 Shelbourne Buildings, Shelbourne Road, Dublin, Ireland, with whom we have concluded contractual agreements on data protection (data processing agreement).

When participating in an anonymous survey, SurveyMonkey also collects information about the device and application used by the data subject to participate in the survey.

Our survey takes place on the website operated by SurveyMonkey. Further personal data may be collected and processed there by this provider itself through the use of cookies (e.g. the IP address). We have no influence on the processing of such personal data by SurveyMonkey.

SurveyMonkey Europe UC is a subsidiary of SurveyMonkey Inc. based in the USA. It is therefore possible that data collected by SurveyMonkey may also be transferred to the USA. The transfer of data to the USA is based on an adequacy decision by the EU Commission. SurveyMonkey Inc. has undertaken to fulfil the requirements of the ‘Data Privacy Framework’.

You can revoke your participation at any time and object to the use of the associated data for the competition (see contact details below). Cancellation of the use of data for the purposes associated with the competition will be treated as cancellation of participation in the competition. Nubert will of course not charge any separate costs for this (in particular, if you notify us by e-mail, you will not incur any costs other than the transmission costs according to the basic tariffs of your provider).

7. Final provisions

Nubert reserves the right to amend or correct these conditions of participation at any time. If the participant does not accept the change to the conditions of participation, they can withdraw their consent by sending an email to info@nubert.de. In doing so, they lose their eligibility to participate.

Legal recourse is excluded. Any liability for damages on the part of Nubert electronic GmbH and its organs, employees and vicarious agents arising from or in connection with the competition, regardless of the legal grounds, is limited to cases of intent or gross negligence, insofar as this is legally permissible.

The conditions of participation and the participation itself are subject to the law of the Federal Republic of Germany. The place of jurisdiction is Cologne.
